Globalization of Law Enforcement
A Study of Transnational Public-Private Partnerships Against Intellectual Property Crimes
Abstract
There are enforceable intellectual property (IP) laws in place in the majority of the 153 member states of the World Trade Organization (WTO). And there are facilitating international organizations (IOs) for law enforcement cooperation that also have a mandate to deal with IP crimes, such as Interpol and the World Customs Organization (WCO). Nevertheless there is a large gap between the law in the books and the law in action in the issue area of IP rights. As a means to close this gap, international cooperation and cooperation with the private sector is being pursued, culminating in transnational public-private partnerships (PPPs) against IP crimes. Examples of such PPPs are the Interpol IP Crime Action Group, the World Customs Organization IP Rights Strategic Group, the World Health Organization International Medical Products Anti-Counterfeiting Taskforce, the World Intellectual Property Organization Advisory Committee on Enforcement, or the Global Congress on Combating Counterfeiting and Piracy. It is the aim of the study to analyze why such PPPs are formed and maintained.
